Copyright & Limited Licence Clause
1. Copyright Ownership
Copyright and all other intellectual property rights in the Drawings, designs, models, specifications, documents and other works produced by the Designer (“the Works”) shall remain the property of the Designer at all times, unless otherwise expressly agreed in writing.
2. Limited Licence
NAT Design grants the Client a non-exclusive, non-transferable, revocable licence to use the Works solely for the purpose of obtaining statutory approvals including planning permission for the Project at the Site, and for no other purpose, unless otherwise agreed in writing.
3. Restriction on Further Use and Third Parties
The Works shall not be copied, reproduced, adapted, issued to third parties, or used as the basis for further drawings, including but not limited to Building Regulations, construction, tender or fabrication drawings, without the prior written consent of the designer - NAT Design.
4. Use by Others / Re-use Fee
Where the Client wishes to appoint others to continue or complete the design, the designers consent may be granted subject to:
payment of an additional copyright licence / reuse fee, and
appropriate limitations on liability in favour of the Designer
5. CAD / Digital Files / Re-use
No CAD or editable digital files shall be released or used by others without a separate written licence / reuse fee.
6. Re-use Fees
If you wish a new consultant to use our drawings as a basis for their work, we can grant a copyright licence for this purpose subject to a reuse fee, these fees start at £700 per project. The fee will be dependant on the size and complexity of the project in question.
This fee covers the licensed reuse of the planning drawings only and confirms that NAT Design has no responsibility or liability for any subsequent design, detailing or construction information prepared by others.
7. No Liability Where Used Without Consent
The Designer (NAT Design) accepts no responsibility or liability for the Works where they are used, amended or relied upon without the Architect’s involvement or consent, or by third parties.
8. Termination
Any licence granted under this agreement shall automatically terminate upon:
non-payment of fees.
Free Site Consultation Terms
1. NAT Design offers a free complimentary site consultation to prospective clients. The provision of a free site consultation is at the sole discretion of NAT Design.
2. A free site consultation will only be offered where the site is within a radius of 10 miles from NAT Design’s office. For sites located beyond this radius, NAT Design reserves the right to charge an hourly rate for the site consultation at its current standard professional fee. £60p/h
3. All consultations, whether complimentary or chargeable, must be scheduled in advance.
